
UPDATE: Supreme Court Justice John Roberts on Monday halted the lifting of Title 42 after attorney generals from 19 states asked SCOTUS to weigh in on the matter.

Supreme Court Chief Justice John Roberts temporarily halted Wednesday’s planned lifting of the Trump-era Title 42 health program Monday after more than a dozen Republican-led states filed an emergency application to the high court.
Roberts gave the Department of Homeland Security until 5 p.m. Tuesday to respond to the appeal by 19 Republican attorneys general and stayed a federal court ruling from last month that ordered the program wrapped up on Dec. 21.
Once the administration’s response is filed, Roberts can deny the states’ application on his own, or — more likely — refer the matter to the full court for consideration.

The crisis at the border could further devolve into “total chaos” if the Biden administration lifts Title 42 border protections, Texas Governor Greg Abbott has warned.
Speaking to ABC’s This Week Sunday, Abbott told host Martha Raddatz ending the Trump-era policy that allows for speedy deportations of illegal immigrants to Mexico would lead to an even bigger influx of border crossers than seen in recent weeks.

“If the courts do not intervene and put a halt to the removal of Title 42, it’s going to be total chaos,” Abbott predicted.
The issue of rescinding the Trump-era Title 42 public health order instituted during the Covid pandemic goes beyond the border to public health, which the three-term Texas governor said is impacted by Covid-infected migrants surging through.
“Whether it’s COVID or some other issue, when you have people coming in from across the globe, without knowing at all what their health status is, that almost by definition is a public health risk,” Abbott responded. “There’s every reason to keep that in place.”
“Some do come across with COVID and no one knows exactly who comes across with COVID — these people are not tested when they come across the border.”
Pushing back on the Texas governor, Raddatz highlighted Biden has never referenced an “open border,” and accused Abbott, DeSantis and Trump of spreading that message.
“You talk about the border wall, you talk about open borders, I don’t think I’ve ever heard President Biden say, we have an open border, come on over. But people I have heard say it are you, are former president Trump, Ron DeSantis, that message reverberates in Mexico and beyond. So they do get the message that it’s an open border and smugglers use all those kind of statements.”
Abbott responded Biden is known for promoting the “open border” notion without openly stating it.
“It was known from the time that Joe Biden got elected that Joe Biden supported open borders,” Abbott said. “It is known by the cartels who have sophisticated information whether or not the Biden administration is going to enforce the immigration laws or not is known across the world but most importantly, known among the cartels.”
In fact, during the 2020 presidential Democrat debates Biden brazenly called on migrants to surge the border.
After an appeals court declined to block the end of Title 42, the Biden administration is set to end the Covid restriction Wednesday, even as Border Patrol resources have been stretched thin accommodating the migrant surge in recent weeks.
Just last month, Breitbart News reported: “As a result, reports indicate that thousands of migrants are waiting in Juarez, Mexico, as well as Tijuana, Mexico, in camps for Title 42 to end in the coming weeks so they can get their chance to rush the southern border.”
