Congress is trying to keep Donald Trump from running for office again by using impeachment as a political weapon, one of Trump’s new lawyers said.

“This is the political weaponization of the impeachment process,” David Schoen stated on Monday. “I think it’s also the most ill-advised legislative action that I’ve seen in my lifetime.”

“It is tearing the country apart at a time when we don’t need anything like that.”

Likewise, constitutional lawyer Robert Barnes also doubted the constitutionality of impeaching the president after he left office, stating that the effort is basically an unconstitutional “bill of attainder” rather than a legitimate impeachment process.

A bill of attainer is an act of legislature declaring a private citizen to be guilty of a crime and punishing him for it.

Barnes said that as far as the US Constitution is concerned, only a current president can be removed from office as outlined by Article I, Section III – a former president obviously cannot be removed from an office he no longer holds.

Additionally, Chief Supreme Court Justice John Roberts said he will not preside over the impeachment, which further outlines its unconstitutionality as the Constitution says “when the President of the United States is tried, the Chief Justice shall preside.”

The Constitution does not lay out any substitutions for the Chief Justice.

The fact that Roberts, who’s not a fan of Trump, refused to take part of the process also suggests he has doubts about its constitutionality.
