
A federal judge has ruled that the Biden administration must enforce the “Remain in Mexico” policy following a lawsuit by Texas and Missouri.
The two Republican-led states sought a preliminary injunction against Biden’s June memo terminating the Trump-era policy, calling it illegal and harmful to U.S. national security.
Judge Matthew Kacsmaryk ordered the Biden administration on Friday “to enforce and implement” the Remain in Mexico policy “in good faith” until it has been “lawfully rescinded” via the Congress.
The Texas and Missouri Attorneys General lauded the ruling on Saturday, calling it a “massive win” for America and a “major loss” for the radical left.
“My office has been leading the way nationally in fighting human trafficking, and the Biden Administration’s lax border policies increase the risk for human trafficking at the border and, in turn, in Missouri,” Missouri AG Eric Schmitt said in a statement.
“Today’s massive win was crucial – re-implementing the Migrant Protection Protocols will help secure the border and fight the scourge of human trafficking.”

Texas AG Ken Paxton also tweeted a statement following the ruling: “Together we sued, and just handed Biden yet another major loss!”

The “Remain in Mexico Policy” – officially called the Migrant Protection Plan (MPP) – was established in 2019 by the Trump administration, where illegal migrants were sent back to Mexico rather than being released into the U.S. as their asylum proceedings were processed.
The ruling also comes as DHS Secretary Alejandro Mayorkas admitted in leaked audio to border patrol agents that the massive influx of migrants coming through the collapsed southern border was “unsustainable” and “cannot continue.”
