A student in Florida was suspended from school last week for the crime of documenting a teacher bullying a classmate.
The audio recording captured the teacher at Samuel Gaines Academy telling a student “Don’t let size fool you. I will drop you….You don’t know me, that’s all I’m saying. So, don’t give me no look.”
The audio also contains a section where the teacher tells the child “You’re the biggest kid in 5th grade and you’re acting like the smallest one… I wonder what your mom looks like.”
When 11-year-old Brianna Cooper took the audio recording to school officials, instead of thanking her for bringing it to their attention, they called it “illegal” and suspended her for five days.
“I thought I did the right thing, but I guess I just got suspended,” Cooper said.
Cooper said that she made the recording because the threats had been going on for some time, but she feared no one would believe it.
“Do you think that they would actually believe a student over a teacher?” she told reporters.
Cooper’s mother Cassie Faulkner is angry at the school’s actions. “You don’t speak to children, let alone students like that,” said Faulkner.
“It’s pretty much saying to students if you think something is wrong, don’t try and do anything about it,” Faulkner said.
“She thought she was doing a good thing. She’s 11-years-old. She doesn’t know the law,” Faulkner said in regards to the “wiretapping” charge against her daughter.
Under the law, recording someone without their knowledge is legal when there is no expectation of privacy. A school would certainly come under this category.
Cooper’s family has hired an attorney, and is looking into the possibility of a lawsuit. Samuel Gaines Academy officials have not responded to requests for comment.
