
UPDATE 3/30/22: The Biden Administration has signaled it will indeed end Title 42, despite warnings from border patrol officials that doing so could lead to a potentially dangerous surge at the southern border that could lead to overcrowding at holding facilities.
The CDC on Wednesday said it would end the pandemic-era rule now that “there is no longer a serious danger” illegals will spread Covid in detention facilities, according to Yahoo News.

America could see an unprecedented flood of illegal aliens that threaten to overwhelm Border Patrol and DHS resources, former and senior border patrol agents are warning.
As the Trump-era Covid restriction on immigration that allowed for speedy deportations known as Title 42 comes up for review, border agents are already seeing surging rates of illegal arrivals which they fear will increase dramatically once the order is lifted.
Discussing his concerns on “Fox & Friends” Wednesday, National Border Patrol Council president Brandon Judd said the surge could potentially overwhelm CBP’s processing capacity.
“We’re fighting fronts that we just don’t have the resources to do it, and if Title 42 goes away, then those floodgates just completely and totally bust open and we’ll be overwhelmed, and we’ll have less resources in the field,” Judd outlined.
“This is a scary situation, and when you look at the number of people that were apprehended that have criminal records, it becomes even scarier. This is a very bad situation right now.”
Former Border Patrol Chief Victor Manjarrez Jr. also warned that if DHS resources are strained, unknown criminal elements could take advantage of the situation and easily infiltrate the US.
“So there are areas along the southwest border that’s certainly not been patrolled to the highest levels that need to be. And so what is it we’re missing? We just do not know we’re missing. That is my biggest fear is what’s out there that we never get our hands on, we never get our eyes on. And it’s coming somewhere into the interior of the United States. That’s the scary thought,” Manjarrez also told “Fox & Friends” Wednesday.

The Department of Homeland Security is hyperaware of the potential collapse of resources.
During a Tuesday news briefing, DHS officials noted they’ve prepared several worst-case scenario contingencies that involve adding thousands of additional staff members and law enforcement officers, air and bus support, hundreds of border agents at critical points of entry, and the construction of temporary facilities to accommodate the unprecedented surge.
DHS estimates at worst anywhere from 12,000 to 18,000 illegals could cross into the US per day, a number which would devastate government processing powers.
Currently Border Patrol agents encounter around 7,100 illegals per day, DHS acknowledges; however, the temporary facilities would only be able to hold up to 16,000 per day, and even those capacity numbers need to be upped to 25,000 or 30,000 in a worst-case scenario.
A DHS memo obtained by ABC News acknowledged the threat:
“The DHS Office of Immigration Statistics (OIS) produced projections for post-Title 42 Southwest Border encounters describing low, medium, high, or very high encounter scenarios… These scenarios underpin planning assumptions that generate requirements which in turn drive operational execution. Based on these projections the SBCC is currently planning for 6,000, 12,000 (high) and 18,000 (very high) encounters per day.”
A senior DHS official also told reporters illegals are arriving from countries outside of Mexico and Central America’s “Northern Triangle.”
“We are now seeing 40% of our monthly encounters coming from countries that are not Mexico, or the Northern Triangle countries of Central America. That is frankly unprecedented and something that is concerning not just to us, but to the government of Mexico and other countries in the region,” one senior official told reporters, noting that they are seeing an influx of Nicaraguan, Cuban and Venezuelan nationals.
It’s unknown exactly when Title 42 could be lifted, however CBS reports the CDC has until March 30 to “determine whether the policy should be kept, changed or terminated.”
“We obviously can’t speak on behalf of the CDC and have no real visibility into their processes,” a DHS official said. “We literally have no idea what’s going to happen, much like you, in the coming days.”
Former DHS official Theresa Cardinal Brown told CBS all hell could break loose if the agency is overwhelmed and underprepared.
“They’re going to face criticism from people who say, ‘You’re letting everybody into the country,’ or people saying, ‘You’re not providing the processing we want to see.’ If their preparations aren’t sufficient, and the facilities get overwhelmed and there are humanitarian issues or disease outbreaks, it’s going to be a challenge,” Brown warned.
