An illegal alien who entered the U.S. two years ago has been apprehended by federal authorities months after a court in Boston released him back to the streets despite charges for rape, kidnapping, and other violent offenses.
On Thursday, Immigration and Customs Enforcement (ICE) announced the arrest of 46-year-old Emilio Jose Pena-Casilla, a citizen of the Dominican Republic who is unlawfully present in the U.S.
On Jan. 9, 2023, U.S. Border Patrol agents caught Pena-Casilla after he illegally crossed the southern border near Eagle Pass, Texas.
Pena-Casilla was then enrolled in the Alternatives to Detention (ATD) program, placed into removal proceedings, and quickly released into the interior.
ICE Enforcement and Removal Operations (ERO) Boston subsequently terminated the Dominican’s enrollment in ATD on February 16, 2023.
On July 15, 2024, Pena-Casilla was arraigned in Dorchester District Court on charges of assault to rape, kidnapping, two counts of indecent assault and battery on a person 14 years or older, and intimidating a witness/juror/police/court official.
ERO Boston quickly lodged a detainer request with the Boston Police Department and then followed up with another detainer request sent to the Nashua Street Jail of the Suffolk County Sheriff’s Office.
“The Dorchester District Court ignored ERO Boston’s immigration detainer and released Pena-Casilla on bail with GPS conditions the next day,” ICE explained in a press release.
ERO Boston officers finally caught up with Pena-Casilla in Boston on Dec. 17, indicating he was on the loose with pending charges for roughly five months.
“Emilio Jose Pena-Casilla stands accused of some very serious offenses against a Massachusetts resident,” ERO Boston acting Field Office Director Patricia H. Hyde said in statement.
“We hold a sacred duty to protect the residents of our communities, and we will continue to do so by apprehending and removing egregious noncitizen offenders from our neighborhoods. Today, another victim in Massachusetts no longer needs to fear their predator.”

Last month, the Boston City Council – which is comprised exclusively of Democrats, one of whom is a former illegal alien – voted 13-0 to reaffirm the city’s status as ‘sanctuary’ for criminal illegal aliens.
