Democratic lawmakers and climate change groups are urging Joe Biden to declare a “climate emergency” that would grant him vast unconstitutional and undemocratic powers in the wake of the Maui wildfires.
“The devastation in Maui is a clear sign that the president must declare a climate emergency — now. While FEMA is providing resources to the local heroes on the ground fighting for the lives and livelihoods of Hawaiians, the underlying climate-driven conditions of drought, extreme heat, environmental injustice, and non-resilient infrastructure will remain,” Sen. Ed Markey (D-Mass.) told POLITICO on Sunday.
Rep. Earl Blumenauer (D-Ore.) likewise argued that if the Hawaii wildfires isn’t a national climate emergency, “what is?”
“I refuse to accept that people choosing between burning alive or jumping into the ocean for hours on end is our new normal. This is a crisis and we need to treat it that way. That starts with President Biden declaring a national climate emergency to unlock vast federal resources and emergency powers to help our communities prepare for and recover from these deadly climate disasters,” he said.
Mark Nevitt, a professor at the Emory University’s School of Law, described the declaration as a “skeleton key” that “unlocks the door” to other unchecked powers.
“It’s not a silver bullet. It could create a backlash,” he told The Hill. “The question is, does it outweigh the political risk?”
The U.S. Oil and Gas Association’s Tim Steward told Just The News that the scope of such a declaration would be vast and unchecked, similar to the government’s emergency powers during COVID.
“If you grant the president’s emergency powers to declare a climate emergency, it’s just like COVID,” Stewart said, adding that “such a declaration would give Biden “vast and unchecked authority to shut down everything from communications to infrastructure.”
And according to a report by The Center for Biological Diversity entitled, “Legal Guide to Bold Climate Action from President Biden,” Biden could take various drastic actions with a climate emergency such as: halt crude oil exports; stop oil and gas drilling in the outer continental shelf; and restrict international trade and private investment in fossil fuels.
Biden has avoided directly committing to such an action, claiming earlier this month that he’s already “practically” declared a climate emergency.
“While we’re trying to deal with this existential threat, this climate change crisis, the president is doing everything that he can to make sure that we are dealing with this…in a way that actually leads to results,” Jean-Pierre said last week when asked if Biden would declare a national emergency. “And that’s what the president is going to continue to do.”
Dr. H. Sterling Burnett, senior fellow at the Heartland Institute, said despite polls showing climate change initiatives are unpopular, Biden could still declare a climate emergency.
“We saw him say, he’d done it… [or] virtually did it,” he told Just The News. “Well, virtually isn’t doing it, but that doesn’t mean he won’t do it in the future because he is talking about it.”
“It gives him tremendous powers, that whole range of authority to dictate things in the economy and people’s actions,” he said.
“The people really pushing for a climate emergency are the fringe in the party. Everyone thinks that people want them to do something big about climate change, but poll after poll shows” people aren’t willing to make sacrifices to appease climate change advocates, he added.
“He wants the Democratic Party to be reelected,” Burnett added. “So, were he to take this step and actually start imposing things before the next election, there’s going to be problems with the polls come voting day.”
