The Nevada Supreme Court on Monday ruled that state officials are allowed to count absentee ballots arriving without a postmark as many as three days after Election Day, shooting down challenges brought by the Republican Party.

The ruling marks a defeat for the GOP in Nevada, where polls show tight margins in the presidential race between former President Donald Trump and Vice President Kamala Harris.

National and state Republicans filed a lawsuit earlier this year against the Nevada Secretary of State and several county clerks, arguing that Nevada’s mail-in ballot deadline is unconstitutional, specifically regarding provisions allowing ballots to be processed even without a postmark if they arrive within three days after Election Day. 

Nevada law requires that all absentee ballots be mailed by Election Day, with a four-day grace period to allow for postal delays, provided the ballots have a postmark verifying it was sent by Election Day.

But the GOP argued that because ballots that lack a postmark may still be counted up to three days after the election, it could lead to problems with ballot validation.

A Carson City District Court judge sided with the state in August, writing: “The public interest is served by ensuring that the maximum number of legitimate voters are counted,” adding that not counting the postmarked mail-in ballots would “disenfranchise voters.”

Now the state’s highest court agreed with the Carson City district court with this latest order.

The Nevada Supreme Court’s ruling was docketed but not fully available as of this writing.

The Federalist cofounder Sean Davis explained how the ruling will grease the skids for Democrats to commit voter fraud in the Silver State.

“Nevada Democrats will now know exactly how many ballots they’ll need to manufacture after polls close, and then they’ll have three days to manufacture them. No postmark necessary means no obstacle to firing up the ballot printer and making it go brrrr,” Davis wrote on X.

How can Nevada voters be expected to trust in a secure election with blatant ballot vulnerabilities like this being accepted in their state?

Meanwhile, the Fifth Circuit Court of Appeals ruled Saturday that mail-in ballots in Texas, Louisiana and Mississippi must be received by Election Day (5 November) in order to count.
