A suspect involved in a Sacramento, California shooting that left six innocent people dead and twelve injured on Sunday was previously released by the state’s Department of Corrections after serving just four years of a ten-year sentence.

27-year-old Smiley Martin and his brother Dandrae Martin were both arrested on Tuesday in connection with the incident.

Smiley was also taken to the hospital following the shootout, indicating the firefight was likely gang-related.

According to the Sacramento Bee, Smiley has a lengthy rap sheet dating back to 2013, including a 10-year sentence for domestic violence and assault with great bodily injury.

Responding to a public records request, the state noted Smiley’s past crimes have included “robbery, possession of a firearm and giving false information to police.”

The most startling crime detailed by the state was an incident where Smiley abused his prostitute girlfriend, with documents explaining he “located her hiding in her bedroom closet and hit her repeatedly with a closed fist on the face, head, and body, causing visible injuries. He then dragged her out of the home by her hair to an awaiting car. After he put her in the car, he assaulted her with a belt.”

The office of Sacramento County District Attorney Anne Marie Schubert wrote a letter last April telling the state that “Inmate Martin’s pattern of conduct” shows he “is an assaultive and non-compliant individual and has absolutely no regard for his victims who are left in the wake of numerous serious offenses.”

“He has no respect for others, for law enforcement or for the law,” the DA’s Office added. “If he is released early, he will continue to break the law.”

Despite the Sacramento County DA warning Smiley Martin “displayed a pattern of criminal behavior” and posed a “significant” threat to his peers, the California Department of Corrections let him out of jail six years early.

A spokesperson for the state explained that when Smiley was sent to serve his ten-year sentence in connection with the assault of his girlfriend, he had already racked up hundreds of days worth of pre-sentencing jail credits in days served related to other crimes.

“Prior to reaching a CDCR facility, Martin had already received 508 days of pre-sentencing credits, and received a variety of additional post-sentencing credits,” the spokesperson wrote in an email. “He was released to Sacramento County probation in February 2022.”

Regarding the Sunday shooting, Sacramento DA Schubert said nobody has been charged with murder or manslaughter yet, and that “The investigation is highly complex involving many witnesses, videos of numerous types and significant physical evidence. This is an ongoing investigation and we anticipate more arrests in this case.”

The Sacramento County coroner reports the women killed were Johntaya Alexander, 21; Melinda Davis, 57; and Yamile Martinez-Andrade, 21, while the three men killed were Sergio Harris, 38; Joshua Hoye-Lucchesi, 32; and De’vazia Turner, 29.

Footage uploaded to Smiley’s social media just before the shooting shows him waving a pistol around and mumbling to the camera.
