An illegal alien who was roaming free after being charged with forcibly raping a minor has been caught by federal immigration authorities in the sanctuary state of Massachusetts.
Immigration and Customs Enforcement (ICE) announced the recent apprehension of 49-year-old Jose Fernando-Perez, a Guatemalan national who has lived illegally in the U.S. for decades.
Fernando-Perez illegally entered the country at an unknown location and date.
In 2005, he was charged with leaving the scene of an accident with property damage and attaching inaccurate license plates.
Seven years later, he was convicted of those charges, but allowed to remain in the U.S.
In 2022, Fernando-Perez was arraigned in Essex County Superior Court on three counts of rape of a child by force and three counts of aggravated rape of a child.
ICE lodged a detainer against the Guatemalan, but the court ignored the request and released him on pre-trial conditions on Oct. 6, 2022.
On Feb. 2, 2025, officers with ICE Enforcement and Removal Operations (ERO) Boston finally caught up with Fernando-Perez and arrested him in Framingham, MA.
He was served with a notice to appear before a Department of Justice immigration judge and remains in ICE custody.

“Jose Fernando-Perez has been charged with some horrific crimes against a minor in our commonwealth,” said ICE ERO Boston acting Field Office Director Patricia H. Hyde.
“He is exactly the type of alien we are targeting with our ‘worst first’ policy. He posed a significant danger to the children of Massachusetts, and we will not tolerate such a threat to our community. ICE Boston will continue to prioritize the safety of our public by arresting and removing egregious alien offenders from our New England communities.”
